Terms of Service

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you” “your” or “User”) and Pretty Princess by JACI Kidz LLC (“Company” “we” “our” or “us”) governing your access to and use of our website located at https://prettyprincesskidz.com, including any subdomains, online platforms, events, products, services, and communications related to the Company (collectively, the “Services”).

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility and Scope

You must be at least 18 years of age or the legal age of majority in your jurisdiction to use or purchase through our Services. By booking or purchasing any service or event, you represent that you are legally capable of entering into binding contracts and have authority to do so on behalf of any minor participant.

2. Bookings, Payments, and Refunds

2.1 Deposits and Payments
All event bookings require a non refundable deposit to secure your reservation. The remaining balance must be paid in full by the due date specified on your invoice or written confirmation. Failure to remit payment may result in cancellation without refund.

2.2 Refund Policy
All deposits are non refundable. Refunds for remaining balances may be granted at the Company’s discretion as outlined in your booking confirmation. Refunds are issued to the original payment method and may take up to ten business days to process.

2.3 Pricing and Modifications
All pricing is in United States dollars unless stated otherwise. We reserve the right to adjust pricing, offerings, and availability.

3. Rescheduling and Cancellations

Rescheduling requests must be made in writing at least fourteen days before the scheduled event. Events may be rescheduled once within ninety days of the original event date. Late cancellations or no shows forfeit all payments.

If the Company must cancel due to weather, safety concerns, or events beyond our control, you may reschedule or receive a credit. Refunds will not be issued for cancellations outside the Company’s control.

4. Event Participation and Conduct

By participating in any event you agree to follow all instructions, safety guidelines, and rules. You remain responsible for supervising minors in your care. The Company provides entertainment and facilitation only and does not provide childcare services.

You must disclose allergies or medical conditions prior to the event. The Company is not responsible for reactions or injuries resulting from undisclosed conditions or failure to follow instructions.

The Company may remove any participant whose behavior is disruptive or unsafe without refund.

5. Assumption of Risk

Participation involves inherent risks including minor injuries or allergic reactions. You assume all risks associated with participation and agree that the Company is not liable for any injury, illness, or damages arising from participation.

6. Medical Treatment Authorization

You authorize emergency medical treatment if needed and agree to assume all related costs.

7. Intellectual Property

All content is the exclusive property of Pretty Princess by JACI Kidz LLC or its licensors. Unauthorized use is prohibited.

8. User Generated Content and Testimonials

By submitting content to the Company you grant us a worldwide royalty free perpetual and irrevocable license to use such content for marketing and related purposes.

9. Photography and Media Release

By attending an event, you agree to photography and video recording for safety, documentation, and promotional use unless you notify us in writing before the event begins.

10. Third Party Services and Links

We are not responsible for third party sites or services.

11. Electronic Communications

By providing your contact information, you consent to receive electronic communications from the Company.

12. Acknowledgment for Minors

Parents and guardians booking for minors confirm they have full authority to consent to participation and media release.

13. Disclaimer of Warranties

Services are provided on an “as is” and “as available” basis without warranties of any kind.

14. Limitation of Liability

Our liability shall not exceed the amount you paid for the specific service or event and excludes indirect or consequential damages.

15. Indemnification

You agree to indemnify and hold harmless the Company from all claims arising from your use of the Services or breach of these Terms.

16. Privacy

Use of our Services is governed by our Privacy Policy.

17. Dispute Resolution and Arbitration

All disputes shall be governed by Georgia law and resolved through binding arbitration in Fayette County Georgia.

18. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control.

19. Modification of Terms

We may update these Terms at any time. Continued use constitutes acceptance.

20. Severability

If any provision is invalid the remaining provisions remain enforceable.

21. Entire Agreement

These Terms and the Privacy Policy constitute the full agreement.

22. Entertainment Purpose Only and Staff Qualifications

22.1 Entertainment Services
All services offered by Pretty Princess by JACI Kidz LLC are for entertainment purposes only. Spa themed services such as mini facials, mini manicures, mini pedicures, mini makeup, and similar activities are cosmetic and recreational. They are not professional salon services.

22.2 No Licensure Representation
The Company does not advertise or represent its staff as licensed nail technicians, estheticians, cosmetologists, or medical professionals. By booking an event, you acknowledge and agree that no licensure is required for entertainment based cosmetic activities under Georgia regulations.

22.3 No Reliance on Professional Standards
You agree not to rely on Pretty Princess by JACI Kidz LLC for any professional beauty, health, or cosmetic service.

23. Staffing, Event Flow, and Substantial Performance

23.1 Staffing Flexibility
Event staffing levels may vary. The Company agrees to provide enough team members to complete the contracted services. Specific staffing numbers are not guaranteed.

23.2 Event Flow Adjustments
The Company may adjust the order or timing of activities to complete the event when delays occur. Adjustments are not grounds for refunds or disputes.

23.3 Substantial Performance
Events are considered fulfilled when the Company substantially performs the contracted services even if certain complimentary items are rescheduled, modified, or delayed.

24. Credit Distinction and Limited Remedies

24.1 Credits vs Refunds
Credits are goodwill gestures and do not equal refunds. Credits cannot be converted to cash.

24.2 Personalized Item Remedies
If personalized items are delayed the Company may replace the item, substitute a comparable item, or issue a courtesy credit.

25. Chargebacks, Disputes, and Liability for False Claims

25.1 Chargeback Restrictions
You agree not to initiate a chargeback based on dissatisfaction with the event experience, staff appearance, staff personality, or subjective opinions.

25.2 Written Notice Requirement
You must notify the Company in writing of any concern within 24 hours of the event. Failure to provide notice waives your right to dispute the transaction.

25.3 No Refund During Active Dispute
Refunds cannot be issued during an active chargeback. The dispute must be withdrawn before any settlement can occur.

25.4 Liability for Invalid Disputes
Invalid or unsupported chargebacks will result in liability for all fees, administrative costs, and any legal or collection expenses incurred by the Company.
